Welcome to Trackule. Please read these Terms of Use ("Terms") carefully before using the Trackule application ("the app") or our website.

By downloading, accessing, or using Trackule, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the app.

1. About Trackule

Trackule ("we", "our") is a personal habit and activity tracking application designed to help you monitor your daily routines and trends.

The app supports:

• Local-only use: Your data is stored exclusively on your device.

• Cloud sync (optional): If you create an account, your data is synchronised across your devices via our secure cloud infrastructure.

2. Licence and Use

We grant you a limited, non-exclusive, non-transferable, and revocable licence to use Trackule for your personal, non-commercial purposes.

You agree not to:

• Use the app for any illegal or unauthorised purpose.

• Attempt to reverse engineer, decompile, or disassemble any part of the app.

• Use the app to harass, abuse, or harm others.

• Interfere with our servers or the proper functioning of the app (e.g. by transmitting viruses or overloading our infrastructure).

3. User Accounts

3.1 Creation and Security

Creating an account is optional. If you choose to create one to enable cloud sync, you are responsible for maintaining the confidentiality of your login credentials (specifically your email account, as we use magic links).

3.2 Termination

We reserve the right to suspend or terminate your account if you violate these Terms or if we believe your conduct is harmful to other users or our service.

You may delete your account at any time within the app's settings. Upon deletion, your cloud data will be permanently removed in accordance with our Privacy Policy.

4. Your Data and Content

4.1 Ownership

You retain all rights and ownership of the data you enter into Trackule ("User Content"), including titles, notes, and tracking entries. We do not claim ownership of your data.

4.2 Licence to Host

By using our cloud sync features, you grant us a limited licence to store, back up, and transfer your User Content solely for the purpose of providing the service to you.

4.3 Data Responsibility

You are responsible for the data you enter. Please do not store sensitive personal information (such as financial details or medical records) in the free-form text fields or notes, as the app is not designed to be a secure vault for such critical data.

5. Intellectual Property

The Trackule app, including its design, code, "Trackule" name, logo, and original content, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without our prior written consent.

6. Disclaimers

6.1 No Medical Advice

Trackule is a tool for self-tracking and information only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider regarding any medical condition. Do not ignore professional medical advice because of something you have tracked or seen in this app.

6.2 "As Is" Service

Trackule is provided "as is" and "as available" without any warranties of any kind, whether express or implied. We do not guarantee that:

• The app will be error-free or uninterrupted.

• Your data will never be lost (we strongly recommend regular backups if using local-only mode).

• Features will remain available indefinitely.

7. Limitation of Liability

To the fullest extent permitted by law, Trackule shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the app.

• Any conduct or content of any third party on the service.

• Any unauthorised access, use, or alteration of your transmissions or content.

8. Changes to These Terms

We may revise these Terms occasionally. The most current version will always be available within the app or on our website. If a revision is material, we will try to provide at least 30 days' notice tailored to the email address associated with your account (if you have one). By continuing to access or use the app after those revisions become effective, you agree to be bound by the revised Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
